Scope
These Terms & Conditions apply to all persons entering or using The Venue, participating in events or competitions, or accessing any services provided by The Venue.
General
Your entry to The Venue and/or use of The App is an acceptance of the terms and conditions set out below.
At the discretion of The Venue anyone found to be acting inappropriately or in violation of these terms and conditions will be asked to leave the premises. No refunds will be given under these circumstances.
Anyone under 18 years of age must be accompanied by a guardian. Events permitting entry for individuals under 18 years of age will be specified.
All persons entering The Venue should respect the property, surrounding businesses, residents, and the local community. In doing so we kindly ask that you minimise any noise you make entering or exiting The Venue.
The Venue is cashless and does not accept payment via cash.
If you have any concerns about any of these terms and conditions please contact the Venue.
Note: Terms and conditions are subject to change. Changes to the terms and conditions will be dated accordingly.
Harassment/Bullying
The Venue maintains a zero-tolerance policy toward verbal or physical abuse, harassment, discrimination, or any other anti-social behaviour. This includes inappropriate conduct directed at another person in online forums or on social media platforms.
The Venue is a safe space where all individuals - regardless of background, race, gender, sexuality, or identity - should feel comfortable and free from bullying, harassment, or discrimination.
Where a person witnesses any such act of harassment or bullying, we ask that you report it to the Venue Staff. Reports can be made directly in person, through The App, or anonymously.
Liability, Compensation, and Indemnity
The Venue may seek financial compensation for any loss, damage, or costs arising from an attendee’s misuse of equipment, gross negligence, intentional damage, or theft. Attendees acknowledge that they may be held financially liable for damage or loss caused by their actions or failure to follow venue rules or staff directions.
The Venue is not liable for any injury, loss, or damage arising from an attendee’s own negligence, misuse of equipment, failure to follow instructions, or unsafe behaviour. Attendees are responsible for using all equipment safely and in accordance with staff directions and venue rules.
Attendees indemnify the Venue for any loss, damage, or liability resulting from their gross negligence, misuse of equipment, intentional damage, theft, or breach of venue rules.
Safety
We ask that any person who is made aware of any safety issue to please leave the area and contact management either by phone, email, or via the app immediately so that it can be rectified.
All people under 18 years of age must be accompanied by an adult guardian at all times.
All Venue Staff are trained in dealing with the concepts surrounding ‘The Angel Shot’ prevalent in many bars and clubs. Anyone feeling uneasy about any situation may speak to Venue Staff and they will act accordingly and assist in managing your safety.
Complaints
If you are unhappy with any service or offering The Venue would appreciate the opportunity to make good any such issue.
The Venue is unable to cater to every individual in every circumstance but will endeavour to do its best to accommodate all people.
A complaints procedure exists for people unhappy with any service and are able to make complaints via The App, via email, or directly to Venue Staff.
Opening Hours
Access is granted to those who have purchased entry to The Venue.
The below times apply only when an event is listed.
The Venue operates at the following times (times subject to change):
- 6:00pm Wednesday to 2:00am Thursday (18+ students night)
- 6:00pm Thursday to 2:00am Friday (18+ paid members only night)
- 6:00pm Friday to 2:00am Saturday (18+ entry only)
- 10:00am Saturday to 6:00pm Saturday (18+ entry only)
- 6:00pm Saturday to 2:00am Sunday (18+ entry only)
- 12:00pm Sunday to 8:00pm Sunday (18+ entry only)
GrydGrynd access is between 2:00am and 8:00am on select special nights early Saturday and Sunday mornings
A lockout applies between 11:30pm Friday til close, and 11:30pm Saturday til close. Re-entry at this time requires use of The App or by contacting Venue Staff.
We ask that you do not attempt to stay longer or gain entry before the opening hours to avoid disappointment.
Accounts
Only one Account may be registered against an email address.
All people with Accounts must have their ID verified and validated on first entry.
All IDs must be in the form of a photo identification.
By validating that you are an adult you will receive access to the chat and social features of the website.
Guardians
Only Legal Guardians may create an Account for a person under the age of 18.
Legal Guardians must have their account validated in person by ID verification.
All Guardians who will be present at The Venue with a person under 18 years of age must have an Account.
Memberships
No joining fee is applicable to the creation of Membership.
A 7-day cooling off period applies to all Memberships where you are able to cancel without incurring further charges.
Memberships have minimum terms associated as listed on the pricing page, automatic payments are scheduled for the 1st day of the month. Your first payment will be pro-rated from date of creation to the 1st of the following month.
Membership may be cancelled after your minimum term lapses. If you choose to cancel within 7 days from the Billing Day (1st of each month) you will be charged for the following month.
If an automated payment is made and you have cancelled before the 7 days leading up to the following month, that payment will be refunded in full with no administration fee associated.
All Memberships are offered to individuals at the discretion of The Venue and may be revoked for a number of reasons including but not limited to anti-social behaviour, theft, harassment, damage, inproper use of equipment, etc.
T33N Membership
T33N Membership where a person under 18 years of age will turn 18 during the course of their Membership will retain access to the same under 18 privileges until expiry. These Members have the option to upgrade to an Adult Membership if they so choose upon expiry.
T33N Membership is made entirely at the discretion of their registered Guardian(s). The contractual obligation of these memberships is made with the Guardian and not the Minor. The Minor is authorised to attend The Venue with statutory, and conduct responsibility falling to The Guardian as part of the binding contract.
T33N Membership requires a Guardian to be present at all times.
A first-in priority waiting list for both T33N Membership will be applied where these limited Memberships are full. We will notify you if a spot becomes available.
L33T Membership
L33T Memberships are limited in number.
A first-in priority waiting list for L33T Membership will be applied where these limited Memberships are full. We will notify you if a spot becomes available.
Membership Types
Membership types available for persons under 18 years of age (requires consent from a Legal Guardian of the person and payments to be made by The Guardian on behalf of The Minor):

Teen memberships will roll-over to Adult memberships automatically on the month following the person turning 18 years of age. Two notifications will be sent via email prior to this rollover to inform of the change which will require action in the months preceding.
On acceptance of a Teen Membership, you must accept the clause allowing a future rollover from a Teen Membership to the equivalent Adult Membership. A person may cancel this Membership at any time before this rollover occurs.
Membership Payments
Memberships are billed monthly in advance on the Billing Day (1st of each month).
Memberships created mid-month will be pro-rated from your membership creation date to the 1st of the following month.
Annual renewals of Memberships will automatically begin on the Renewal Notice Date (1 year from your membership creation date).
Monthly memberships on their expiry date will continue to automatically be billed on a month-to-month basis. You may cancel at any time (see Membership information above).
Bookings
Pre-Booking by members can be made within the following timeframes depending on your membership type:
- 8-Bit - Seven (7) days prior
- 16-Bit - Ten (10) days prior
- 32-Bit - Twelve (12) days prior
- 64-Bit - Fourteen (14) days prior
- L33T - Twenty-one (21) days prior
All individuals making a Booking must pay in full to secure the booking.
Any bookings made may be cancelled prior to 72 hours of The Booking time without incurring further penalty. Cancellation made between 24 and 72 hours before the booking incur a standard Booking Admin Fee of $4 from the booking fee.
Note: Bookings can't be cancelled within 24 hours. We ask that you are confident of your booking and those attending can make it prior.
Attendance
The Venue has a maximum number of attendees and at times may be full. We apologise for any inconvenience this may cause.
The Venue will not over-book and if you have purchased tickets for a night you will always be granted access.
The Venue and The App do not allow over provision of any facilities or services.
The Venue is a private space and is not open to all people at all times.
At times staff may ask that you vacate an area for any number of reasons, this may be because a booking is being prepared for, or because the area needs to be cleaned, we ask that you respect the request of Venue Staff.
Kitchen/Storage Facilities
The use of fridges on premise is complimentary and available to all in attendance. We ask that at no point do you impact on any other persons property in any way without the consent of that person. Anyone found to be doing so will be asked to leave immediately. Further action may be taken depending on the severity.
The kitchen equipment should only be used for the purpose it is intended for. Only place food/beverage items in the fridges and be mindful of the health and safety of others.
The Venue has lockers available to store items temporarily during staffed hours (and sometimes for Special Events overnight). Please ask at reception for access to a locker.
Returning the key to a locker can be done by either handing the key back at reception, or dropping the key in the lock box at reception if unattended.
Use of Equipment/Appliances
Access to and use of any Equipment or Appliances is a privilege and should be done so responsibly.
Where a person is unaware of how to appropriately use any piece of Equipment or Appliance they are to ask staff of The Venue how to do so before any such use.
Incorrect operation or handling of any Equipment or Appliance at The Venue that causes damage may be asked to leave.
The Venue makes every effort to provide working equipment at all times, unfortunately from time to time equipment may require maintenance and be out of order or unavailable for booking.
The Venue appreciates if you come across any failure of equipment, that you contact staff directly.
All game discs/catridges are not to be handled by any person unless authorised by the staff of The Venue.
Security
At no time is any person to take any of The Venue’s property including but not limited to board games, controllers, console games, PCs, peripherals, magazines, books, computers, screens, etc. or any property that you do not personally own between floors, or outside of the main entrance.
Your access page has the QR code that needs to be scanned to authorise your entry into each floor of the venue.
No Tailgating is allowed. Do not allow others to enter Secured Areas behind you, and don’t try to enter Secured Areas behind others unless you are in their party/group and are already pre-validated (via the tablet at reception on level 2). This is for the benefit and safety of all people who attend The Venue.
Only enter secured areas of the building if you have access to those areas. If you are unsure, you should always ask staff of The Venue.
Note: No bags should be left unattended at any time. All persons in attendance should be respectful of others and their possessions however we make no assurance or guarantees regarding the security of a persons belongings. This is the responsibility of the owner.
Privacy and Access
The Venue values your privacy and safety and will at all times keep information shared by you with The Venue safe and secure.
The App is your single point of reference for all things associated with The Venue. The App will mature and change over time to provide greater access and amenity. It is important that you have a working phone, or access to your account via a device in order to gain entry and access to the products and services on offer.
All people in attendance will be required to create an account using The App without exception. The information provided must be accurate and true as this information will be verified against a legal form of identification in order to allow you entry to The Venue.
BYO Information
All BYO alcohol is to be unopened on entry. We will ask you to dispose of any opened alcohol prior to entry.
No spirits are allowed, no cocktails are to be made on premise by anyone in attendance. Premix beverages are allowed.
We do sell non-alcoholic beverages to adults at The Venue for consumption. All of these products have 1.15% or less alcohol by volume (ABV).
Concealed alcohol is prohibited. We ask anyone in attendance to show staff all drinks/food you are bringing into The Venue for consumption.
No alcohol is permitted during times Teens may be present in The Venue. This is to maintain a healthy and safe environemnt for all.
Alcohol is only allowed to be brought into The Venue by paying Attendees during an event. In very limited cases alcohol may be permitted to be carried onto premise by individuals with prior approval by Venue Staff and without extension to any other individual or third-party.
Alcohol may only be consumed indoors and is not allowed to be taken outside once opened. Failure to adhere to this rule will likely result in you being asked to leave The Venue.
Consumption of alcohol at The Venue is to be done only within the areas defined on the map viewable by logging in to The App. Consumption outside these zones will result in the person being asked to leave by Venue Staff.
Any open bottles that are not empty should be taken only if you have a screw-top, and we ask kindly you not consume this alcohol outside The Venue before or after attendance.
Note: At no time should you leave your drink unattended. All drinks should be opened and/or poured by the person drinking them, and once open/poured kept with your person, including any larger opened bottles (such as a wine bottle) used to fill a glass/cup. Areas designated for alcohol storage is under constant video surveillance.
Caution: It is an offence under multiple statutes/laws within Australia to tamper with someone else's drink/food. Under the Crimes Act 1900 s38/s38A, multiple indictable/summary offences are associated with this behaviour when brought before the courts.
Sponsorship
Sponsorship grants a sponsor certain limited rights within The Venue as defined within your Sponsorship Agreement.
If you are a sponsor of The Venue you will adhere to the terms governing your Sponsorship Agreement.
Any sponsor who solicits any information from any Member or Non-Member of The Venue must uphold the values of The Venue.
A sponsor is legally required to uphold the same moral and ethical standards as businesses operating independently with relation to NSW privacy laws, and the Terms and Conditions defined by The Venue.
Advertising
Sponsors and Partners will be allowed to advertise to Members at The Venue and this advertising may be in the form of physical signage, in person communication, digital advertising via a website, The App, or equipment at The Venue.
Acceptance of any service or product provided by a Sponsor or Partner endorsed by The Venue may form a binding agreement with a third-party. In no way is The Venue liable for any agreement a person makes with that third-party.
All advertising at The Venue must be suitable for minors, must not include any links or QR codes directing to gambling products or services, and must not have direct or indirect association with the sale of explicit material.
Business/Operating Partners
Partners of The Venue agree to honour the terms set out on any agreed conditions as part of their Partnership Agreement.
Any Partner or their representatives that is in attendance at The Venue is to follow any directions made by Venue Staff.
Consent
You consent to staff of The Venue checking your bags on entry to The Venue.
While all our staff are trained in the responsible service of alcohol (RSA), we do not sell or provide alcoholic beverages for consumption at The Venue.
A Guardian must accompany any individual under the age of 18 at any time Minors are permitted into The Venue.
You grant non-exclusive rights to The Venue to use as they see fit any opinion, review, media, video, stream, image that you add in digital form to The App with the provision that that material is not altered in any way that would substantially impact on the likeness, meaning, or context of the original works. This excludes information relating to your privacy such as age, phone number, full name, address, and other data stored relating to your identity.
You agree to allowing watermarking of original works by The Venue any of the above-mentioned digital assets you upload to The App. This may include things such as competition results, personal interest photos or graphics, and associated social photos taken either in The Venue or elsewhere.
Gambling/Betting
All gambling and betting is prohibited at The Venue in any form.
No direct or indirect promotion of gambling related services or products is endorsed by The Venue relating to any current or future Competition by The Venue or its associated entities.
Any third-party who is either a sponsor, or in association with The Venue agrees to not make any representation of any gambling, betting, or lottery based service or product directed toward promoting these to either members, or non-members while at The Venue, through The App, or an associated discussion forum.
Competitions
All competitions run by The Venue are determined by games of skill and are not in any way related to a lottery of any sort.
Both prize and/or cash winnings are available depending on The Competition as determined by The Venue. See the prizes page for information.
Any monetary consideration for Winners in a competition is advertised at the start of The Competition and is non-negotiable.
Prizes as Winnings may be either selected by Competition Winners, or pre-selected by The Venue depending on The Competition.
Competition ladders are set out differently depending on The Competition. By entering The Competition you accept the scheduling, and terms that are detailed for The Competition.
A Competition Schedule will be available 72 hours prior to the commencement of The Competition. If the Competition Schedule does not work for you please talk to The Venue at your earliest convenience. If you cannot attend, you can choose to forfeit your position in The Competition and we will refund you your Competition Entrant Fee in full.
If the scheduling is significantly problematic during The Competition due to unforeseen circumstances (such as weather events, technical issues, health issues of key staff, etc) we will only continue if all Competitors still competing for a prize place are in agreement. Where a Competitor still competing is not in agreement, we will then attempt to find another date to continue the competition and if no such date can be found, we will refund all Competitors their Competition Entrant Fee.
If you have not confirmed your attendance and choose to forfeit within 24 hours of The Competition you will not be refunded your Competition Entrant Fee if you are not in attendance.
Teams competing who have a reduced team due to an illness or in-attendance can elect another team member or choose to compete with a reduced team. If a team chooses to compete with less players, no handicap will be determined and the team must compete without a weighted benefit.
The determination of the percentage of Winnings or the number of places that receive Winnings is at the discretion of The Venue.
All Winnings for each placement in The Competition will be advertised prior to the event start by The Venue.
1st Place in The Competition will always receive the highest accolade or prize, followed by 2nd Place and 3rd Place. An outright 1st place is required so a tie-break will be adminsistered either by points counting, or by an additional game. 2nd and 3rd place may tie and depending on the competition and will result in 2nd and 3rd place sharing the total sum of prizes allocated for those places respectively.
4th place and below depending on The Competition may or may not be of monetary value at The Venue’s discretion.
Trying to gain an advantage through any means not directly associated with the game will likely lead to disqualification. Examples of this include but are not limited to any form of cheating, use of aimbots, use of AI tools, harassment, bullying, anti-social name calling that makes someone uncomfortable, or other activities which can readily be classified as poor sportsmanship.
Filming/Photography
Filming and or photography within The Venue is permitted for personal use only. We ask that atendees who are seeking to take photos or video within The Venue to respect the rights of others relating to privacy, safety, and security.
Any commercial filming or photography purposes is not permitted without the express written consent of The Venue, this includes for the purposes of conducting live streaming to a channel or external service or for post-processing at a later stage for the purpose of being uploaded to a service for any purpose. These services include but are not limited to Youtube, Twitch, Instagram, Facebook, TikTok, and other services.
We ask that any person that is filming or taking photos do so with permission from any person who may be identifiable in the photograph or film.
Those who are accessing the streaming pods do so with full permission of The Venue to conduct live video streaming for both personal and/or commercial purposes.
Note: No filming or photography is permitted that would jeopardise a persons privacy or safety regardless of whether you feel you have permission to do so. Please be mindful of others and their wishes.
Caution: Consent can only be obtained from someone when it is free, voluntary, and informed. This means that intoxication directly undermines their ability to give informed consent. This burden lies with the individual(s) seeking consent.
Creative License
The Venue is under active video surveillance at all times both inside and outside of the premises. By entering The Venue, or being present in and around the premises, you consent to being filmed by CCTV for security purposes.
Venue Staff will at times take photography of different aspects of The Venue. This photography may include you, and this photography may be used by The Venue for direct marketing purposes. You consent to this use and waive all rights or connection to this material.
Any photography posted by The Venue is not intended to cause harm or distress to an individual. If you take issue with any content posted on social media please contact us directly
All rights will be retained and vesting held by The Venue of all digital assets whether that be film, photography, or literature unless formally granted rights are given to an individual, group, or business.
All Streamers accessing streaming pods will have full and exclusive rights to content they produce, stream, document, and broadcast through the use of those systems unless otherwise formally agreed between The Streamer and The Venue. Any indivdual who is part of that stream, interview, or creation, accepts the content may be used by the Streamer to promote their brand, profile, or business(es) through that process. This right does not extend beyond the Streaming Pod unless formally agreed in writing by The Venue.
At times a Streamer may be granted dual rights as part of an ongoing competition or broadcast run by The Venue.
Glossary
| Account | A collection of mandatory details about any member or non-member stored in The App. |
| Admin Fee | A fee applied for general administration tasks. |
| Advanced Booking | Booking made by a person to secure a place ahead of time at The Venue. |
| Appliances | Refers to, but not limited to microwaves, fridges, dishwashers, kettles, coffee machines, etc. |
| Attendee | A member or non-member that attends The Venue |
| Billing Day | The day of the month that is defined for automatic payment to be transacted. |
| Booking | A place within The Venue a person has secured at a time of their choosing. |
| Booking Cancellation Fee | A fee applied based on the value of the Booking. |
| Competition Entrant Fee | The fee that an Attendee pays in order to have an opportunity in a specific competition organised by The Venue. |
| Competition Schedule | The time, place, and details set out that define when a Competitor will be available to play in The Competition to successfully advance. |
| Competitor | A person who has registered for a competition and paid their Competition Entrant Fee. |
| Entry Fee | The monetary fee defined at a time to gain access to The Venue. |
| Equipment | Refers to, but not limited to, console systems, PC systems, monitors, TVs, amplifiers, electronic tablets, peripherals (such as keyboards, mice, headsets, controllers, steering wheels), etc. |
| Guardian | An individual responsible for the contractual and supervisory aspects of a minor. |
| GrydGrynd | Our extended special hours gaming events purchasable as extended tickets to standard tickets. |
| Joining Fee | A fee applied at the creation of memberships. |
| Member | Any person who has elected to pay a monthly fee to The Venue for access. Past or present. |
| Minimum Membership Term | A term that is the minimum time a person must pay for a Membership before the opportunity to cancel it. |
| Minor | An individual under the age of 18. |
| Non-Member | Any person who has chosen to pay an entry fee to The Venue for access. Past or present. |
| Payment Advice | A payment advice is a notice of payment to be made to The Venue. |
| Secured Areas | Areas in the building that have physical security readers to restrict access. |
| Staffed Hours | The hours The Venue will have staff present to assist in providing products and services to attendees. |
| Streamer | A person using the streaming pods to conduct interviews, live stream, produce content, promote their brand, broadcast, podcast, commentate, etc. |
| Streaming Pods | A designated set of rooms in The Venue that allow a Streamer to push live or pre-recorded content to their personal or commercial social media or business platforms. |
| Tailgating | Entering through a door closely behind someone else without individually gaining access via standard security procedures. |
| The Competition | Any competition being organised and run by The Venue. |
| The Venue | The physical location at 23 Watt Street, Newcastle, NSW operated by Lateral Continuity Pty Limited (trading as GrydGaming) under the direction of its management team. |
| The App | The iOS, Android, Windows, or Web-based application that is used to manage various features at The Venue. |
| The Board | The sitting board of directors in connection with the operation of The Venue and/or its associated company(ies). |
| Total Booking Fee | The fee payable by a person before the booking time. |
| Venue Staff | Any person directly under the employ of The Venue. |
| Winnings | Any monetary or prizes awarded to a Competitor for placing in a competition. |
